Summary In August 2007, Mehri & Skalet, PLLC filed a class action complaint against American Standard Companies, Inc., on behalf of Plaintiff Stephen Laney, and a putative class of customers who purchased the “Champion” model toilet.
The Champion toilet features a proprietary flushing mechanism that American Standard represents is “the best thing to happen to toilets since indoor plumbing.” The Complaint alleges that the flushing mechanism was defectively designed, and as a result, it is prone to break and leak. Despite the fact that the toilet comes with a 10-year “worry-free” warranty, American Standard has failed to fix the problem or to cover the cost of repairs.
Plaintiff has brought claims for breach of warranty, breach of contract, unjust enrichment, and a claim under the New Jersey Consumer Fraud Act.
