CTC Real Estate Services v. Lepe (2006)140 Cal.App.4th 85Brett argued this case before the California Court of Appeals and won. The case was published andstands for the proposition that a victim of identity theft can potentially trace the profits gained by the thief though the use of the victim’s identity. This case has drawn interest from as far away as London, as it is the first of its kind in California (one of the first internationally) and provides additional rights to victims of identity theft that had not previously existed.
